§ 1 Definitions
For the purposes of these Terms and Conditions, the following terms shall have the following meanings:
Terms and Conditions – these Terms and Conditions
Store – the online store operating at https://towardsyou.pl
Customer – a natural person, legal person, or organizational unit that is not a legal person but has legal capacity under specific regulations, placing an Order in the Store
Seller – Aldona Gaudyn, conducting unregistered business activity under the name TOWARDS YOU, Tax Identification Number (NIP): 665-266-07-25
Product – goods and services presented in the Store for sale, including those produced and delivered in digital form available within the Store, in particular psychological tests or coaching. Products are sold for a fee, unless expressly stated otherwise.
Order form – a form of the Store, through which the Customer can place an Order and execute a Sales Agreement.
Order – an action, a declaration of will of the Customer aimed directly at concluding a Product Sales Agreement with the Seller and performing a service for the Customer, under the terms and conditions specified in these Terms and Conditions.
Sales Agreement – an agreement for the sale of a Product concluded between the Seller and the Customer via the Store.
Distance Agreement – an agreement concluded with the Customer within the Store, without the simultaneous physical presence of the parties, with the exclusive use of one or more means of distance communication up to and including the moment of conclusion of the agreement.
PDF (abbreviation for Portable Document Format) – a file format of the same name, developed by Adobe Systems.
Consumer Rights Act – the Act of May 30, 2014 on consumer rights (Journal of Laws of 2014, item 827, as amended), hereinafter referred to as the Act.
Civil Code – Act of April 23, 1964 (Journal of Laws No. 16, item 93, as amended), hereinafter referred to as the Civil Code.
Act on the provision of electronic services – Act of July 18, 2002 on the provision of electronic services (Journal of Laws No. 144, item 1204, as amended), hereinafter referred to as UŚUDE.
§ 2 General provisions
1. The Terms and Conditions describe the rules of operation of the online store operated as part of the https://towardsyou.pl website, which is owned by the Seller.
2. The information about the Products provided on the Store's website, in particular their descriptions, technical parameters, and prices, do not constitute an offer within the meaning of the Civil Code, but are merely an invitation to conclude a contract within the meaning of Article 71 of the Civil Code.
3. The rules for using the Online Store and the conditions for making purchases within it are set out in these Terms and Conditions.

5. The condition for using the Store and concluding a Sales Agreement is the acceptance of the provisions of these Terms and Conditions. By accepting them, the Customer agrees to all provisions and undertakes to comply with them.
§ 3 Services provided electronically
1. The Seller provides services to the Customer electronically via the Store.
2. The basic service provided electronically to the Customer by the Seller is to enable the Customer to place an order in the Store, leading to the conclusion of a contract with the Seller. Placing an order is possible without the need to have a Customer Account in the Store.
3. In order to ensure the security of the Customer and the transfer of data in connection with the use of the Store, the Seller takes technical and organizational measures appropriate to the level of security risk of the services provided, in particular measures to prevent the acquisition and modification of personal data by unauthorized persons.
4. The Seller takes measures to ensure fully correct functioning. The Customer is entitled to inform the Seller of any irregularities or interruptions in the functioning of the Store.
5. Any complaints related to the functioning of the Store may be submitted by the Customer via e-mail to kontakt@towardsyou.pl. In the complaint, the Customer should provide their first and last name, the Product to which it relates, their email address, as well as the type and date of the irregularity related to the functioning of the Store. The Seller will consider all complaints within 14 days of receiving the complaint and will inform the Customer of its decision at the email address of the person submitting the complaint.
§ 4 Placing an order
1. The Customer may place an order via the Store.
2. An order is placed by filling in the order form after adding the products of interest to the Customer to the shopping cart.
The form requires the provision of data necessary to complete the order. The condition for placing an order is the acceptance of the Terms and Conditions, which the Customer should read beforehand. If the Customer has any doubts regarding the Terms and Conditions, they may contact the Seller.
3. The order placement process is completed by clicking on the button finalizing the order. The Customer receives information about the payment method in the Order Form. After successful payment, the contract is considered concluded between the Customer and the Seller. Confirmation of the conclusion of the contract will be sent to the Customer to the e-mail address provided in the order form.
4. The Customer must provide true personal data in the order form. The Customer is responsible for providing false personal data. The Seller reserves the right to suspend the order if the Customer has provided false data or if the data raises reasonable doubts as to its correctness. In such a case, the Customer will be informed by phone or email about the Seller's doubts. In such a situation, the Customer has the right to explain all circumstances related to the verification of the accuracy of the data provided. If there is no data allowing the Seller to contact the Customer, the Seller will provide all explanations after the Customer has made contact.
5. The Customer declares that all data provided by them in the order form is true, while the Seller is not obliged to verify its truthfulness and correctness, although they have such a right in accordance with paragraph 4 above.
6. Depending on the subject of the order, a specific type of contract may be concluded between the Customer and the Seller:
o in the case of physical services – a sales contract,
o in the case of psychotes and online services – a contract for the delivery of digital content.
7. If the subject of the order includes products of different types, placing the order leads to the conclusion of several specific types of agreements corresponding to the subject of the order.
§ 5 Prices, payment methods
1. The prices of Products listed on the Store's website are given in Polish zlotys, are gross prices and include all taxes required by applicable law.
2. The Seller reserves the right to change the prices of Products presented in the Store, introduce new Products, withdraw Products, conduct promotions and offer discounts, as well as temporarily offer Products free of charge. The above right does not affect Orders that were placed before the date of entry into force of any of the changes. The details and duration of each promotion are always included in the description of the Product.
3. The duration of each promotion is limited. Discounts and promotions do not accumulate.
4. The Customer is obliged to make payment within 2 business days from the date of receipt of the message confirming the acceptance of the order by the Seller.
5. The order will be processed after the payment has been credited to the Seller's bank account within the time limits specified in the Product descriptions.
6. At the Customer's request, the Seller will issue an invoice. In such a case, the Customer should inform the Seller on the day of payment.
§ 6 Order fulfillment and delivery methods
1. The fulfillment of the ordered product begins after the total value of the order has been credited to the Seller's bank account.
2. The order fulfillment time is counted from the moment of positive payment authorization.
3. Coaching, mentoring, or coaching-mentoring sessions should take place within one month of payment.
4. Psychological tests and their discussion should take place within one month of the payment being credited to the account.
5. The Customer has the right to change the date of the meeting twice, informing the Seller 24 hours in advance at kontakt@towardsyou.pl. If the Customer fails to notify the Seller of their absence, cancels or reschedules less than 24 hours before the agreed date, or fails to attend the meeting, they shall bear the full cost of the missed session.
6. The person participating in the psychological tests will use tools intended for adults, unless the Product description states otherwise.
7. Online development sessions take place via Google Meet, and stationary sessions take place in Poznań at ul. Milczańska 5 or Winklera 27a.
8. The Seller undertakes to perform its services in a professional manner and with due diligence, in compliance with all ethical standards.
9. All available delivery methods or methods of performing the ordered products are described on the Store's website and presented to the Customer at the stage of placing the order.
10. In the case of orders for electronic products, such as psychological tests, access to the products is granted immediately after the payment is credited to the Seller's account, but no later than within 3 business days from the moment the payment is credited.
11. In the case of physical products (face-to-face meetings), the Seller specifies the available methods of providing these services, which are described on the Store's website and presented to the Customer at the time of placing the order and after it has been placed.
§ 7 Warranty and complaints
1. The Seller is obliged to deliver to the Customer a product and digital content free from defects.
2. The Seller shall not be liable for digital products for which it acts as an intermediary: Gallup, DiSC, MTQ48, MTQPlus, MTQSport, and ILM72 tests.
3. Details regarding the Seller's warranty for defects are governed by the provisions of the Civil Code (Articles 556–576).
§ 8 Withdrawal from the contract
1. A Customer who has concluded a distance contract with the Seller has the right to withdraw from the contract without giving any reason within 14 days from the date of taking possession of the purchased items (in the case of a sales contract) or within 14 days from the date of conclusion of the contract (in the case of a contract for the supply of digital content). To meet the deadline, it is sufficient to send a statement before its expiry.
2. The right to withdraw from the contract does not apply to contracts for the delivery of digital content, i.e. psychometric tests and services that have already been performed. Psychological tests are considered to have been performed if the Customer has already received an email notification about the assignment of the test unit. A session with the Customer that took place online or in person is considered to be a service that has been performed.
3. The moment of commencement of the contract for the delivery of digital content is the delivery of an email to the Customer with access to the psychological test.
4. To withdraw from the contract, the Customer must inform the Seller of their decision to withdraw from the contract by means of an unequivocal statement, for example, by sending an email to kontakt@towardsyou.pl. The statement should include: Name and surname, proof of purchase (order and payment confirmation).
5. If it is necessary to refund the funds for the transaction made by the Customer, the Seller shall refund the payment using the same method of payment as used by the Customer.
6. The purchase cost will be refunded within 14 days from the date on which the Seller was informed about the withdrawal from the contract by the Customer.
§9 Intellectual property rights, license, and copyright
1. The Seller hereby informs the Customer that the content of the Store, electronic products, online courses, digital content, and text, graphic, and photographic materials included in physical products are protected by copyright.
2. The unlawful distribution of the content or materials referred to in paragraph 1 above, in whole or in part, shall constitute a violation of copyright and may result in criminal or civil liability.
3. The Seller informs that the use of fragments of works is permitted only within the limits specified by law. It is not permitted to correct, modify, or re-edit works, nor to use the Seller's works in other commercial activities.
§10 Personal data and cookies
1. The Seller is the administrator of the Customer's personal data.
2. The Customer's personal data is processed for the purpose of handling orders, user accounts, and possible defense, investigation, or determination of claims related to contracts concluded through the Store.
§11 Out-of-court dispute resolution and consumer claims
1. The Seller agrees to submit any disputes arising in connection with the concluded contracts to mediation. The details will be determined by the parties to the dispute.
2. The Consumer has the option of using extrajudicial means of complaint handling and claim enforcement. Among other things, the Consumer has the option of:
a. applying to a permanent consumer arbitration court for a decision on a dispute arising from the concluded contract,
b. apply to the provincial inspector of the Trade Inspection with a request to initiate mediation proceedings for the amicable resolution of the dispute between the Customer and the Seller,
c. seek the assistance of the district (municipal) consumer ombudsman or a social organization whose statutory tasks include consumer protection.
d. More detailed information on out-of-court methods of handling complaints and pursuing claims can be found on the website http://polubowne.uokik.gov.pl.
e. The Consumer may also use the ODR platform, which is available at http://ec.europa.eu/consumers/odr. The platform is used to resolve disputes between consumers and entrepreneurs seeking an out-of-court settlement of a dispute concerning contractual obligations arising from an online sales contract or a contract for the provision of services.
§12 Final provisions
1. Any disputes between the Store Owner and the Customer who is a consumer within the meaning of Article 221 of the Civil Code shall be settled by the courts having jurisdiction in accordance with the relevant provisions of the Code of Civil Procedure.
2. Any disputes between the Store Owner and a Customer who is not a consumer within the meaning of Article 221 of the Civil Code shall be settled by the court having jurisdiction over the Store Owner's registered office.
3. In matters not covered by these Terms and Conditions, the relevant provisions of Polish law shall apply.
4. The Seller reserves the right to make changes to the Terms and Conditions. Contracts concluded before the change to the Terms and Conditions shall be governed by the Terms and Conditions in force on the date of conclusion of the contract.
